These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services made available by Order Center Co LLC (“Pharmacy Time,” “we,” “us,” or “our”), including pharmacytime.com and any related subdomains, mobile experiences, portals, and support channels (collectively, the “Platform” or “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Services.
IMPORTANT NOTICE: MEDICAL / EMERGENCY DISCLAIMER.
THE SERVICES FACILITATE COORDINATION AND COMMUNICATION WITH INDEPENDENT LICENSED HEALTH CARE PROVIDERS AND/OR PHARMACIES. THE SERVICES DO NOT REPLACE YOUR RELATIONSHIP WITH A PHYSICIAN. PHARMACY TIME DOES NOT PROVIDE MEDICAL CARE AND DOES NOT PRACTICE MEDICINE OR PHARMACY. DO NOT USE THE SERVICES FOR EMERGENCY CARE. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER) IMMEDIATELY.
ARBITRATION NOTICE & CLASS ACTION WAIVER (READ CAREFULLY).
THESE TERMS REQUIRE MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, AND INCLUDE A CLASS ACTION WAIVER. YOU ARE WAIVING THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
1) Definitions
- “Platform” / “Services” means our digital platform and related tools, including user accounts, checkout, messaging, scheduling, customer support, educational content, and other features we provide.
- “Provider” means an independent licensed clinician or physician group/practice that is contracted with a third-party professional entity and/or network to provide clinical services (including telehealth) where legally available. Providers are not our employees unless explicitly stated in writing.
- “Pharmacy” means an independent, appropriately licensed pharmacy that may fulfill prescriptions, dispense medications, and ship products, including pharmacies within a contracted pharmacy network.
- “Prescription Products” means products available only with a valid prescription issued by a Provider.
- “Non-Prescription Products” means OTC products, wellness products, or other items not requiring a prescription.
- “Content” means all text, graphics, images, videos, software, and other materials on the Services.
- “User Content” means content you submit through the Services (messages, uploads, feedback, etc.).
2) Services Overview; No Medical Services by Pharmacy Time
2.1 Platform Role
Pharmacy Time provides a technology and administrative platform that may help you:
- access information about health and wellness;
- coordinate interactions with independent Providers (including telehealth where available);
- coordinate fulfillment and shipping through independent Pharmacies;
- manage administrative tasks such as identity verification, intake collection, checkout, order status, and customer support.
2.2 No Practice of Medicine or Pharmacy
Pharmacy Time does not provide medical diagnosis or treatment and does not dispense medications. Any clinical decisions (including prescribing) are made solely by Providers. Pharmacy fulfillment and dispensing decisions are made solely by Pharmacies in accordance with applicable law and professional standards.
2.3 Not for Emergencies
Do not use the Services for emergency or crisis care. If you believe you have an emergency, call 911 immediately.
3) Eligibility; Availability; Geographic Restrictions
3.1 Age
You must be at least 18 years old to use the Services. Some services or products may require you to be 21+ depending on the jurisdiction and product category.
3.2 U.S. Only
The Services are intended for persons located in the United States. Access from outside the U.S. is at your own risk and you are responsible for compliance with local laws.
3.3 Location Accuracy
You represent that you are located in the state you indicate and that your information is accurate. Providers and Pharmacies may rely on this information for legal compliance.
4) Registration; Account Security
You may need an account to access certain Services. You agree to:
- provide accurate, complete information;
- maintain and update your information;
- keep your credentials confidential and secure;
- notify us immediately of unauthorized access or suspected breaches.
You are responsible for all activity under your account.
5) Telehealth; Electronic Communications; Informed Consent
5.1 Telehealth Nature
If you use telehealth services via the Platform (if available), you understand telehealth may include:
- electronic transmission of medical records, images, and personal health information;
- video, audio, and messaging-based interactions;
- use of data from devices and self-reported information.
5.2 Risks of Telehealth
You understand telehealth has potential risks including, without limitation:
- limitations in clinical evaluation due to lack of in-person physical exam;
- technical failures or delays;
- privacy or security risks, despite reasonable safeguards.
5.3 Consent to Electronic Communications
You consent to receiving communications from us, Providers, and Pharmacies electronically, including via email, SMS, portal messages, and push notifications, regarding your account, orders, treatment coordination, and legally required notices. You are responsible for monitoring these communications.
5.4 No Guarantee of Security
No transmission method is 100% secure. You consent to the electronic transmission of information as part of using the Services.
5.5 Provider Consent
Providers may present additional telehealth consent forms or disclosures. Those will control for the Provider relationship.
6) Prescriptions; Medical Appropriateness; Provider Relationship
- Only a Provider can determine whether you are a candidate for treatment and whether to prescribe any medication.
- Providers may refuse care, may require additional information, and may change or discontinue treatment at their discretion and as clinically appropriate.
- Nothing on the Platform is a guarantee that you will receive a prescription, specific medication, dosage, or timeline.
7) Pharmacy Fulfillment; Shipping; Substitutions
7.1 Pharmacy Selection
If a Provider issues a prescription, you may be offered fulfillment through a contracted Pharmacy network and/or may choose a pharmacy where available. You authorize us to share necessary information with Pharmacies to facilitate fulfillment.
7.2 Fulfillment Is Not Guaranteed
Fulfillment depends on lawful prescribing, pharmacy discretion, inventory, verification, and regulatory restrictions. Pharmacies may decline to fill based on professional judgment or legal requirements.
7.3 Shipping & Delivery
Delivery timelines are estimates. Once shipped, responsibility may pass to the carrier. Some shipments may require signature and/or age verification.
7.4 Product Changes
Due to availability, regulatory constraints, or clinical considerations, Providers and/or Pharmacies may recommend or dispense an alternative (e.g., different manufacturer, concentration, packaging, or equivalent where legally permitted). You may have options to accept or decline, subject to program terms and applicable policy.
8) No Insurance; Financial Responsibility
Unless explicitly stated otherwise in writing, Services are offered on a cash-pay basis. We and/or Providers may not accept or bill insurance. You are solely responsible for charges incurred through your use of the Services.
If you are a beneficiary of a federal or state health program, you agree you are choosing a cash-pay pathway and that no claim will be submitted on your behalf unless explicitly disclosed and legally permissible.
9) Payments; Authorization; Taxes
9.1 Payment Authorization
By providing payment information, you authorize us (and/or our payment processors) to charge your payment method for amounts due, including product costs, shipping, taxes, and applicable fees.
9.2 Pricing Changes
Prices may change at any time, subject to applicable law. The price at checkout controls for that transaction.
9.3 Chargebacks
If you initiate a chargeback without first contacting support, we may suspend your account and pursue lawful recovery options.
10) Refunds; Returns; Cancellations (General Policy)
Because prescriptions and certain health-related products may be regulated and/or temperature-sensitive, returns are generally not accepted once shipped or fulfilled, except where required by law.
We may maintain separate refund/return policies for certain product categories. If there is a conflict, the specific policy disclosed at checkout controls for that transaction.
11) Future Programs (If Offered)
This Section applies only if and when we choose to offer these programs. We do not promise availability. Any program may be modified or discontinued at any time to the extent permitted by law.
11.1 Subscription Plans (If Offered)
We may offer subscription plans that provide recurring access to certain products, non-prescription items, or administrative platform features (“Subscription Plans”). If offered:
- you will be told the price, frequency, and what’s included before enrollment;
- your subscription will renew automatically unless you cancel;
- cancellation timing may affect whether a renewal charge is avoided;
- some subscription purchases may be non-refundable once an order is processed.
11.2 Automatic Refills / Autopay (If Offered)
We may offer optional automatic refills for certain eligible products (“Auto-Refills”). If offered:
- Auto-Refills are opt-in only;
- you may cancel at any time through your account or by contacting support (subject to cutoff times);
- refill timing may be adjusted for safety, supply, or compliance reasons;
- Providers and/or Pharmacies may require renewed clinical review or updated intake before continued fulfillment.
11.3 Weight Management Programs (If Offered)
We may offer weight management or lifestyle support programs (the “Programs”). If offered:
- Programs may include educational content, coaching, and coordination with Providers where clinically appropriate;
- no medical outcome is guaranteed, including any specific amount or rate of weight loss;
- participation may be subject to clinical eligibility criteria determined by Providers;
- separate program terms may apply and will be presented at enrollment.
11.4 Promotional Credits (If Offered)
We may offer promotional credits, discounts, or coupons (“Credits”). If offered:
- Credits have no cash value unless required by law;
- Credits may expire and may be revoked for fraud, misuse, or violation of Terms;
- Credits may not apply to shipping, taxes, or Prescription Products unless explicitly stated;
- we may limit stacking, redemption frequency, or eligible items.
11.5 Referral Rewards (If Offered)
We may offer referral programs that provide rewards to referrers and/or referred users (“Referral Program”). If offered:
- participation may be limited by geography, age, and eligibility criteria;
- rewards may be promotional and non-transferable;
- self-referrals and abuse are prohibited;
- separate referral terms will apply and will control.
12) Privacy; Health Information
Our Privacy Policy explains how we collect, use, and share personal information. If you engage with Providers or Pharmacies, your information may also be governed by their policies and by applicable privacy laws (including HIPAA where applicable).
You agree that we may use and disclose information as described in our Privacy Policy, including to facilitate Services, comply with law, prevent fraud, and improve the Platform.
13) Intellectual Property; License to Use the Services
13.1 Our Content
We own or license the Services and Content. You may not copy, modify, distribute, sell, reverse engineer, or exploit any portion of the Services except as allowed by these Terms.
13.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms.
13.3 Trademarks
All trademarks, logos, and service marks are our property or the property of third parties. No rights are granted except as expressly stated.
14) User Content; Feedback
You may provide User Content (including feedback). To the extent permitted by law:
- you grant us a worldwide, royalty-free, sublicensable license to use User Content to provide, maintain, and improve Services, and for customer support, quality, and compliance purposes;
- do not submit content you do not have the right to share;
- do not post sensitive personal or health data in public areas (if any).
If you provide suggestions or feedback, we can use them without compensation or obligation.
15) Acceptable Use; Restrictions
You agree not to:
- misuse the Services, attempt unauthorized access, or interfere with security;
- impersonate others or provide false information;
- upload malware or harmful code;
- scrape the Services without written permission;
- use the Services for unlawful purposes or to violate any laws;
- harass Providers, staff, or other users;
- use the Services to develop competing products using our Content or confidential processes.
We may investigate suspected violations and take action including suspending accounts.
16) Third-Party Services; Links
The Services may link to or integrate third-party services. We do not control third parties and are not responsible for their content, policies, or actions. Use at your own risk.
17) Disclaimers
THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AND AVAILABILITY.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
WE DO NOT ENDORSE OR GUARANTEE ANY PROVIDER OR PHARMACY’S SERVICES, OUTCOMES, OR QUALITY.
18) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PHARMACY TIME OR ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:
(a) $100, OR
(b) THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent permitted.
19) Indemnification
You agree to indemnify and hold harmless Pharmacy Time and its affiliates and representatives from claims, losses, liabilities, damages, and expenses (including attorneys’ fees) arising from:
- your misuse of the Services;
- your violation of these Terms;
- your violation of law or third-party rights;
- your fraud, negligence, or misconduct.
20) Termination; Suspension
You may stop using the Services at any time. We may suspend or terminate access if we believe you violated these Terms, pose risk, or for compliance reasons, with or without notice where permitted.
Sections that by their nature should survive termination will survive (including arbitration, disclaimers, limitation of liability, IP, and indemnity).
21) Changes to the Services or Terms
We may update the Services and these Terms from time to time. Changes are effective when posted, unless the law requires otherwise. Your continued use after changes means you accept them.
22) Communications (SMS, Email, Calls)
22.1 Transactional & Service Communications
You consent to receiving communications related to your account, orders, and coordination.
22.2 Marketing
If you opt in, you may receive marketing communications. You can opt out via unsubscribe links, account settings, or replying “STOP” to SMS where applicable.
22.3 Unencrypted Communication Risk
SMS and standard email may not be encrypted. If you choose to receive sensitive information via SMS/email, you do so at your own risk.
23) Dispute Resolution; Arbitration; Class Action Waiver
23.1 Informal Resolution First
Before initiating arbitration, you agree to contact us to attempt resolution:

Include your name, account email/phone, and a description of the dispute and desired resolution.
23.2 Binding Arbitration
Except for the exclusions below, any dispute arising from or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified here.
23.3 Exclusions
Either party may:
- bring an individual action in small claims court (if eligible);
- seek injunctive relief for IP misuse or unauthorized access;
- seek temporary relief in court to preserve rights pending arbitration.
23.4 No Class Actions
YOU AND PHARMACY TIME AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
23.5 Venue & Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent any claim is not subject to arbitration, exclusive venue shall be in the state or federal courts located in Broward County, Florida, and you consent to jurisdiction there.
23.6 Time Limit to File
To the maximum extent permitted by law, any claim must be brought within one (1) year of the event giving rise to the claim, or it is barred.
24) Miscellaneous
- Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement regarding the Services.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No Waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign your rights. We may assign these Terms in connection with a merger, acquisition, or sale.
